Refund conditions
1.8 Art.52 of Legislative Decree 206/2005 (Consumer Code): subject to the exceptions referred to in article 59, the consumer has a period of fourteen days to withdraw from a distance contract or contract negotiated away from business premises without having to provide any reasons and without having to incur costs other than those provided for in article 56, paragraph 2, and in article 57. Without prejudice to article 53, the withdrawal period referred to in paragraph 1 ends after fourteen days from :a) in the case of service contracts, from the day of conclusion of the contract;b) in the case of sales contracts, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the goods or:1) in the case of multiple goods ordered by the consumer through a single order and delivered separately, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the last good;2) in the cas or delivery of a good consisting of lots or multiple pieces, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the last lot or piece;3) in the case of contracts for periodic delivery of goods during a certain period of time, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the first good; c) in the case of contracts for the supply of water, gas or electricity, when they are not offered for sale in a limited volume or in a determined quantity, district heating or digital content not supplied on a tangible medium, from the day of conclusion of the contract.3. The parties to the contract can fulfill their contractual obligations during the withdrawal period. However, in the case of contracts negotiated away from business premises, the professional cannot accept, by way of consideration, bills of exchange which have a maturity of less than fifteen days from the conclusion of the contract for service contracts or from the acquisition of physical possession of the goods for sales contracts and cannot present them for discount before this deadline.
1.9 Art. 53. (Consumer Code) Non-fulfilment of the obligation to inform on the right of withdrawal: 1. If in violation of article 49, paragraph 1, letter h), the professional does not provide the consumer with information on the right withdrawal, the withdrawal period ends twelve months after the end of the initial withdrawal period, as determined in accordance with article 52, paragraph 2.2. If the trader provides the consumer with the information referred to in paragraph 1 within twelve months from the date referred to in Article 52, paragraph 2, the withdrawal period ends fourteen days after the day on which the consumer receives the information.
1.10 Art. 54. (Consumer Code) Exercise of the right of withdrawal:1. Before the expiry of the withdrawal period, the consumer informs the trader of his decision to exercise the right of withdrawal from the contract. To this end, the consumer may: a) use the model withdrawal form set out in Annex I, part B; or b) submit any other unequivocal statement of your decision to withdraw from the contract. 2. The consumer has exercised his right of withdrawal within the withdrawal period referred to in article 52, paragraph 2, and in article 53 if the communication relating to the exercise of the right of withdrawal is sent by the consumer before the expiry of the withdrawal period. 3. In addition to the possibilities referred to in paragraph 1, the professional may offer the consumer the option of completing and sending electronically the model withdrawal form set out in Annex I, part B, or any other explicit declaration on the website of the professional. In such cases, the professional shall immediately communicate to the consumer a confirmation of receipt, on a durable medium, of the withdrawal exercised.4. The burden of proof relating to the exercise of the right of withdrawal in accordance with this article rests with the consumer.
1.11 Art. 55. (Consumer Code) Effects of withdrawal:1. The exercise of the right of withdrawal puts an end to the obligations of the parties: a) to perform the distance contract or contract negotiated away from commercial premises; or b) to conclude a distance or off-premises contract where an offer has been made by the consumer.
1.12 Art. 56 (Consumer Code) Obligations of the professional in the event of withdrawal: 1. The professional reimburses all payments received from the consumer, possibly including delivery costs, without undue delay and in any case within fourteen days from the day on which informed of the consumer's decision to withdraw from the contract pursuant to article 54.
